Delhi HC refuses to order special assembly session for tabling CAG reports | India News – The Times of India

NEW DELHI: The Delhi high court on Friday refused to direct the Delhi legislative assembly to hold a special session for tabling the Comptroller and Auditor General (CAG) reports.
“Court is not inclined to accept the petition for summoning a special session for laying the reports,” Justice Datta said.
The bench, led by Justice Sachin Datta, however, noted the delays by the Delhi government in tabling the reports. The court said that tabling the CAG reports is mandatory under the Constitution but refrained from passing a judicial order to summon the assembly.
The petition was filed last year by opposition leader Vijender Gupta and BJP MLAs Mohan Singh Bisht, Om Prakash Sharma, Ajay Kumar Mahawar, Abhay Verma, Anil Kumar Bajpai, and Jitendra Mahajan. Advocates Neeraj and Satya Ranjan Swain represented the petitioners.
During the hearing, the Delhi government and the assembly speaker opposed the plea, arguing that there was no urgency to present the reports before the elections, as the assembly’s tenure would end in February. The assembly secretariat added that no useful purpose would be served by tabling the reports at this stage and highlighted that such matters fall within the assembly’s internal functioning.
Earlier, during a hearing held on January 13, the court said the CAG reports should have been promptly placed before the assembly for discussion and the state government “dragging its feet” on the issue raised “doubts on its bonafides”.
However, the court reserved its final order on January 16 after hearing arguments from all parties.
