Elliott was jogging when he found Antonio García Avalos sleeping in the middle of the sidewalk. An argument began between the two leading Elliott to shoot Avalos.

A sixty-eight-year old man from South California filmed himself shooting and killing a homeless man he woke up for blocking a sidewalk. The Orange County district attorney said Craig Sumner Elliott, 68, was jogging in September 2023 with two of his dogs in Garden Grove, California, when he encountered Antonio García Avalos. Avalos was a forty-year-old homeless man who was asleep in the middle of the sidewalk.

Elliott was with a pushcart and he first used the cart to wake Avalos by using the cart to nudge him. He pushed the cart onto him in a bid to wake him up so that he could get around him. Avalos woke up and began yelling at Elliot and asked him to get away from him.

Elliott was charged with felony voluntary manslaughter and felony enhancement of personal use of a firearm. He is accused of grabbing a handgun from his pushcart and firing the homeless man, according to a press release from the Orange County district attorney’s office accessed by the CNN.

The district attorney’s office said Elliott possessed an active concealed carry permit from the Orange County Sheriff’s Department when the shooting happened.

The district attorney’s office said Elliott had an active concealed carry permit from the Orange County Sheriff’s Department when the shooting happened.

An active concealed carry permit, also known as a concealed carry licence, is an official authorization that allows an individual to carry a concealed firearm in public in many states of the United States.

This permit is issued either by the state government or police department after the completion of a background check and the fulfilment of specific requirements, such as training or a waiting period. The permit holder is legally allowed to carry a concealed firearm for personal protection.

The video, according to authorities, showed Avalos hurling a shoe at Elliott, who is able to duck the shoe. Seconds later, Elliott is seen shooting Avalos three times. Avalos later died from his injuries.

He was arrested on a warrant on November 17 and was released after posting a $100,000 bail on November 20. He is scheduled to be arraigned on December 15 and could face a maximum sentence of 21 years in state prison if convicted.
