The Supreme Court has taken suo motu cognisance of an Allahabad High Court order that controversially stated “grabbing breasts” and “breaking pyjama” did not amount to rape but an attempt to rape.

The Supreme Court on Tuesday took suo motu cognisance of a controversial order passed by the Allahabad High Court, which stated that “grabbing breasts” and “breaking pyjama” did not constitute rape, but rather an attempt to rape.
The remark, made on March 17, was made while modifying the charge of attempt to rape to a lesser offence under Section 354(b) of the Indian Penal Code (IPC).
In its order, the high court had reduced the charge of attempt to rape to Section 354(b), which deals with assault or criminal force to a woman with intent to disrobe her.
