Addressing the controversy surrounding the alleged embezzlement of donations at the Ram temple in Ayodhya, Justice Atul Sreedharan of the Allahabad High Court has observed that nothing can shame those who remain unfazed by such a development. In a searing 51-page opinion, the judge described the alleged theft as the “proverbial last straw” and the “nadir of Indian integrity”, reflecting how deeply dishonesty has been normalised across society.
‘Bulldozer Justice’ Case
The sharp observations emerged during a ruling on executive demolitions, commonly termed “bulldozer justice”. Justice Sreedharan noted that an average citizen has grown so accustomed to corruption that it is no longer viewed as a moral failing unless caught.
Highlighting global standing, he pointed out that India ranking 91st out of 182 nations in the Transparency International 2025 report fails to evoke collective embarrassment. The judge stressed that when a sacred site like the Ram temple suffers donation theft without triggering widespread public outrage, it signals a collapse in foundational ethics.
Root Causes and Retributive Discretion
Connecting institutional corruption to civic issues, Justice Sreedharan explained how unauthorised constructions develop with the connivance of dishonest officials. Municipal bodies often overlook violations due to bribes or political patronage, only to execute sudden, punitive demolitions decades later.
- State Complicity: By providing municipal connections like water and electricity to illegal structures, the state acts as an accomplice before selectively enforcing laws.
- Selective Enforcement: Wealthy and influential violators often remain untouched, while poorer residents bear the brunt of sudden administrative action.
- Retributive Executive Action: Demolishing homes immediately after an offence is registered serves to satisfy a perceived social demand for summary punishment, bypassing judicial trial.
Split Verdict and Legislative Reforms
The observations formed part of a split verdict alongside Justice Siddharth Nandan in a case involving targeted property demolitions in Hamirpur. While both judges agreed that using municipal powers to punish criminal suspects is unconstitutional, they differed on procedural remedies. Justice Sreedharan proposed a two-year moratorium on demolitions for accused persons, causing the matter to be referred to a third judge.
To curb unchecked dishonest practices, Justice Sreedharan urged Parliament to consider amending the Prevention of Corruption Act, 1988, suggesting capital punishment for corruption convicts to retrieve the country from systemic decay.
